TrackPoint Copyright Policy

TrackPoint Technologies Inc. ("TrackPoint," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This Copyright Policy describes our procedure for handling claims of copyright infringement in accordance with Canadian law.
Reporting a Claim of Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content on the TrackPoint platform infringes upon your copyrights, you may submit a notification of claimed infringement ("Notice") to our Copyright Agent. Your Notice must be in writing and include the following:
• Identification of the copyrighted work you claim has been infringed.
• Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate the material (e.g., providing a URL).
• Your contact information, including your name, address, telephone number, and email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Your physical or electronic signature.

Our Response to a Notice
Upon receipt of a valid Notice, we will take whatever action we deem appropriate, which may include promptly removing or disabling access to the allegedly infringing material. We will also notify the user who posted the material and provide them with an opportunity to respond.
Counter-Notification
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may send a counter-notification to our Copyright Agent. The counter-notification must include:
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
• Your contact information, including your name, address, telephone number, and email address.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• A statement that you consent to the jurisdiction of the Federal Court of Canada and that you will accept service of process from the person who provided the original Notice.
• Your physical or electronic signature.
Repeat Infringers
In accordance with our policy, we will terminate the accounts of users who are determined to be repeat infringers.
Changes to this Copyright Policy
TrackPoint reserves the right to modify this Copyright Policy at any time. The updated policy will be posted on our website, and your continued use of our services after such changes constitutes your acceptance of the new policy.
